THE 1987 CONSTITUTION OF THE STUDENT GOVERNMENT OF FEATI UNIVERSITY

P R E A M B L E

We, the students of FEATI University, in order to establish a student government that shall embody our ideals, protect our rights, promote our welfare, foster solidarity and unity among us, establish rapport with the university administration and work for the advancement of our goals and aspirations, based on justice, freedom and democracy, do hereby ordain and promulgate this constitution.

ARTICLE I

SCOPE AND APPLICATION

Section 1. This constitution shall apply to all students of FEATI University, Manila.

ARTICLE II

DECLARATION OF PRINCIPLES AND OBJECTIVES

Section 1. This student government shall be democratic, popular and representative and all student government authority emanates from the students. It shall adhere to and pursue the following objectives in order to realize human existence for all:
  a. The promotion of the total and well-rounded development of every students;
b. The protection and promotion of the rights and welfare of the students
c. The development of the sense of service and responsibility among the students to enable them to utilize educational opportunity to the maximum in the promotion of unity and enhancement of the welfare not only of the university but the whole academic community as well;
d. The development of a wholesome attitudes of the students in their interactions among themselves, with the faculty, with the university and with the bigger society to which they belong;
e. To seek and support educational reforms along nationalistic, humanistic and scientific methods for the full development of the human potential to enable it to respond to social realities and to the promotion of academic freedom;
f. To serve as an active form of student ideas and sentiments; and
g. To adhere to democratic principles, practices and processes and abide by the rule that the majority prevail over the minority, subject to the right of the minority to be heard.


ARTICLE III

BILL OF RIGHTS

Section 1. No student shall be subjected to disciplinary action without due process of law or without his side being heard.

Section 2. The students shall enjoy freedom of speech, of expression, of the press or the right to peacefully assemble to petition their own student government and the university for redress of their grievance in the school.

Section 3. The students shall have the right to be informed; thru the FUSSC, of school rules, regulations and policies that are intended for and directly affecting them as students.

Section 4. The students shall have the right to have access to their own official records subject to the university regulations and confidentiality of school records, to an expeditious issuance of their official transcript of records, grades, certifications, diploma and other similar school documents.


ARTICLE IV

BILL OF DUTIES AND OBLIGATIONS

Section 1. The students shall abide by and perform the following duties and obligations:

  a. The duty and obligation to uphold this constitution, to honor and respect FEATI University and, to obey and observe at all times the rules, regulations and/or policies of FEATI University, the Department of Education, Culture and Sports and the laws of the land;
b. To exercise his rights properly and responsibly, with due regard to the rights of his fellow students and all others;
c. To promote peace and harmony among all the various constituencies or segments of the university in order to create and maintain a peaceful and orderly academic community that is conducive to learning;
d. To cast his vote in every election, plebiscite, referendum or in any other activity when called upon to do so; and
e. To assist in the dessimination of rules, regulations and policies of the university and of the FUSSC and at the same time in the teaching and advising of their fellow students on the proper observance of such rules, regulations and policies.

ARTICLE V

GOVERNING BODY/COMPOSITION

Section 1. The governing body of the student government of FEATI University is a council called "FEATI UNIVERSITY SUPREME STUDENT COUNCIL (FUSSC)."

Section 2. The FUSSC shall be composed of the following: a President; a Vice-President; a Secretary; a Treasurer; an Auditor; a Business Manager; a Press Relation Officer; a Sergeant-at-Arms; and the Representatives representing the course-departments of the university to be apportioned on the ratio of one (1) representative for every 1000 students or a fraction thereof of not less than 500 students in each course-department; provided, however, that a course department regardless of the size of its enrollment shall have at least one representative.

Section 3. The President, Vice-President, Secretary, Treasurer, Auditor, Business Manager, Press Relation Officer and Sergeant-at-Arms, shall all be elected by popular vote by all the students of the university while the representatives shall be elected by popular vote by all the students of the course-department that each one of them represents.


ARTICLE VI

GENERAL POWERS AND FUNCTIONS OF THE PRESIDENT

Section 1. The FUSSC President shall be the Chief Executive and the head of the student government.

Section 2. He shall be the official spokesman and representative of the student government and of the FUSSC on all matters affecting the students and where the FUSSC and the student government are supposed to be heard or represented.

Section 3. He shall appoint from among the members of the FUSSC the student representative to the Committee on Student Organizations and Activities (CSOA).

Section 4. The first President of the FUSSC under this constitution shall upon assumption of office, immediately create an Ad-Hoc Committee composed of members of the FUSSC to draft the by-laws defining the specific duties and functions of the FUSSC President and the other members of the FUSSC mentioned in Section 2 of the immediately preceding article, and such by-laws to be valid must be concurred in by at least a majority of all the members of the FUSSC and approved by the President of the university.

Section 5. He can create and dissolve committees, appoint and remove the members of said committees at will depending upon the needs of the FUSSC and the exigencies of the time, for the effective implementation of the programs of government of the FUSSC; provided, however, that the members of said committees shall come only from the ranks of the FUSSC or DSC.

Section 6. He may assign to any other members of the FUSSC such other duties and functions that are inherent in their respective positions that they respectively hold.

Section 7. He may perform such other duties and functions as are inherent in his positions as Chief Executive of the FUSSC and as head of the student government.


ARTICLE VII

GENERAL POWERS AND FUNCTIONS OF THE FUSSC

Section 1. The FUSSC shall be the policy making body of the student government.

Section 2. It shall serve as the forum where problems, complaints and/or any other matter involving the students shall first be discussed, deliberated upon by the FUSSC as a body before they are brought to the attention of the university for appropriate action.

Section 3. It may enact rules and regulations, ordinances or resolutions, as the case may be, which are binding upon all the students; provided, however, that such ordinance and/or resolutions shall not be inconsistent with or contrary to the rules, regulations and policies of FEATI University, of the department of Education, Culture and Sports and of the laws of the land.

Section 4. It shall fix the honorarium of the FUSSC President, COMELEC members, Auditors, Advisers and the other officers of the FUSSC that it shall determine to be also entitled to receive honorarium.


ARTICLE VIII

DEPARTMENT STUDENT COUNCIL

Section 1. Each course-department shall be governed by a council called the DEPARTMENT STUDENT COUNCIL (DSC). It shall be composed of the following: a President; a Vice-President; a Secretary; a Treasurer; an Auditor; a Business Manager; a Press Relation Officer and a Sergeant-at-Arms.

Section 2. The Department Student Council shall be under the supervision of the FUSSC to insure harmony and synchronization of their functions and to see to it that the rules, regulations, and policies that the department-council may promulgate and adopt are not inconsistent with or contrary to the rules, regulations and policies of the FUSSC and of the university.

Section 3. The members of the DSC shall be elected by popular vote by all students of the corresponding course-department in the same election that the members of the FUSSC are elected.


ARTICLE IX

QUALIFICATIONS AND DISQUALIFICATIONS

Section 1. To qualify as member of the FUSSC or DSC a candidate must have the following qualifications and none of the following disqualifications:

 

a. Qualifications- The following are qualified:

1. Those enrolled in FEATI University in the semester (excluding summer) immediately preceding and at the time of the election with a subject load in either semester of not less than 15 academic units and, for the load in the previous semester, must have obtained a general average of not less than 2.5, with no failing grade of (5), of marks of "Inc". "Dropped" and/or "NE", provided; however, that the marks of the "Inc", Dropped" and/or "NE" may be waived if satisfactorily explained to the COMELEC that they were due to fortuitous event, force majeure, illness and other similar causes beyond the control of the candidate;
2. First year students with a general average as indicated in their report card (form1370 of not less than 85% or its equivalent;

b. Disqualifications- The following are disqualified;

1. Alien Students;
2. Students who are also employees of the university;
3. Members of the editorial staff of "THE FEATINIAN";
4. Students who have been convicted in court in final judgment of violating any of the laws of the land or have been found violating any of the serious offenses prescribed by the Student Code of Conduct and Discipline of FEATI University;
5. Students who without justifiable reason as determined by the COMELEC, did not cast their vote in the preceding election;
6. Students graduating or expecting to graduate in the 1st semester of the school year; and
7. Students who are members of outlawed or subversive organizations.


ARTICLE X

TENURE OF OFFICE/VACANCIES

Section 1. The members of the FUSSC and the DSC shall hold office for one (1) year counted from the date of their induction into office or until their successors shall have been duly elected, qualified and inducted into office, with right of re-election only for another term.

Section 2. If a permanent vacancy occurs in the office of the President at any time during his term of office, the Vice President shall become the President.

Section 3. If the vacancy is only temporary, the Vice President shall only act as President until the President resumes his duties.

Section 4. If the offices of the President and Vice president simultaneously become vacant and the vacancy occurs before the middle part of the second semester, a special election under the direct supervision of the COMELEC shall be held within two weeks from the date of the vacancy to elect the successors. Those elected shall serve only the unexpired portion of the term.

Section 5. If the permanent vacancy mentioned in the immediately preceding section shall take place between the middle part of the second semester and the end of the ensuing summer session, the FUSSC shall elect from the representative-members of the council the Acting President and Acting Vice President. The COMELEC shall supervise the election and those elected shall serve only the unexpired portion of the term.

Section 6. If at anytime during the one year tenure of office a permanent vacancy occurs in any office in the FUSSC or DSC, the President of the FUSSC shall appoint the successor who shall be designated by the political party to which the replaced officer belongs but if this should not be possible, the president of the FUSSC shall appoint as the successor the candidate for that same position who garnered the next highest number of votes in the election.


ARTICLE XI

MEETING/QUORUM

Section 1. The FUSSC and the DSC shall meet regularly at least once every week.

Section 2. Special meetings may be called from time to time by the FUSSC President or by the DSC President, as the case may be, to take up matters outside the agenda of the regular meetings.

Section 3. Special meetings may also be called, as the case may be, upon the written request of at least 12 members of the FUSSC or at least 5 members in the case of the DSC. T he request must specify the agenda of the special meeting and the reasons therefor.

Section 4. The President of the FUSSC or the DSC as the case maybe, shall preside over all of these meetings. The secretary of either council shall likewise take and keep the records of the proceedings in these meetings.

Section 5. A majority of the FUSSC or DSC, as the case maybe, shall constitute a quorum to transact business. Except as otherwise herein provided, a majority vote of the members constituting a quorum is sufficient to arrive at a decision.

Section 6. If a quorum cannot be constituted the FUSSC or DSC shall adjourn to compel the attendance of absent members in such manner and under such penalties that they may impose.


ARTICLE XII

RULES OR PROCEDURE

Section 1. The FUSSC and DSC may determine the rules of their respective proceedings provided such rules shall not be inconsistent with the generally accepted rules on parliamentary proceedings.
Section 2. In the absence of such rules, the rules as provided in the Robert's Rule of Order on parliamentary proceedings shall apply.

ARTICLE XIII

ACCOUNTABILITY OF OFFICERS

Section 1. Any office in the FUSSC or DSC is a public student trust. The officers holding them must at all times be accountable to the students, serve them with utmost responsibility, integrity, loyalty, efficiency and dedication to duty. They should lead as good examples to their fellow students.

Section 2. Any member of the FUSSC or DSC maybe removed or suspended from office by a vote of at least 2/3 of all the members of the council concerned. The punishment is without prejudice to any other disciplinary action as maybe warranted under the rules and regulations of the university, particularly the Student Code of Conduct and discipline.

Section 3. A member of the FUSSC or DSC who holds the position of President, Chairman or any other position of equal rank in any recognized student organization in the university shall, to avoid conflict of interest, immediately resign his/her position in said organization upon his/her induction into office. The letter-resignation must be filed with the FUSSC President or DSC President, as the case maybe. Violation of this provision shall perpetually disqualify the members from holding any office in the FUSSC or DSC.


ARTICLE XIV

FUNDS/DISBURSEMENTS

Section 1. The funds of the FUSSC or COUNCIL FUND shall come from the fees, called "COUNCIL FEE' paid by the students during enrollment time. The Council Fee is Five Pesos and Fifty Centavos (P5.50) per student. The Council Fee maybe increased upon a Resolution approved by at least vote of the FUSSC and approved by the President of the University.

Section 2. The Council Fund shall be apportioned between the FUSSC and the various DSCs on the ratio of 70% for the FUSSC and 30% for the DSC, the latter share to be computed on the basis of the total enrollment of each course department for each semester or summer as certified by the Registrar of the University.

Section 3. The Council Fund shall be deposited in the name and account of the FUSSC with a reputable commercial bank easily accessible and most convenient, practicable and expenditious to meet the needs of the FUSSC.

Section 4. No withdrawal from the account of the FUSSC in the bank shall be made unless upon the joint signatures of either the President or Treasurer of the FUSSC on one hand and by the signature of either one of two representatives to be designated by the President of the university on the other hand.

Section 5. No disbursement out of the Council Fund shall be made unless supported by a written resolution duly approved by at least a majority of the FUSSC or the DSC, as the case maybe. Disbursements for a private purpose are strictly prohibited. Those responsible for this kind of disbursement shall be liable for expulsion from the council.

Section 6. The Honorarium provided, for in Section 4 of Article VII thereof and all other expenses necessary in and incidental to the holding of any election, referendum or plebiscite under this constitution as well as expenses necessary in and incidental to the normal and official activities and operations of the FUSSC shall be charged against the Council Fund.


ARTICLE XV

AUDITING OF FUNDS

Section 1. The Council Fund shall be audited by the Auditor of the FUSSC jointly with and independent Auditor to be designated by the Dean of the Institute of Business Administration from among the students of that Institute. This auditor must not be a candidate in the election or an active member or officer of any political party, which participated in the election.

Section 2. The funds of the DSC shall be audited by the auditor of that department council jointly with an independent auditor to be designated by the faculty adviser of that department council from among the students of that course-department. This auditor must not be a candidate in the election or an active member or officer of any political party, which participated in the election.

Section 3. The disbursements and expenditures of the FUSSC and DSC shall be audited monthly at the end of each months by the auditors concerned.

Section 4. There shall be no disbursements or expenditures out of the Council Fund for the following month or months unless the monthly audit requirement provided for in Section 2 above is complied with.

Section 5. Any FUSSC or DSC officers or members, who refuses to have the accounts of the council audited as provided for in Section 2 shall be expelled from the council and be subject to disciplinary action for grave misconduct and/or dishonesty.


ARTICLE XVI

COMMISSION ON ELECTIONS

Section 1. There shall be an impartial and independent Commission on Elections (COMELEC) composed of a Chairman and four members.

Section 2. The Chairman shall be appointed by the President of the university from one of the faculty members of the university. Of the four members, two shall be instructors appointed by the President of the university acceptable to the FUSSC, while the remaining two shall be designated by the FUSSC from among the students who are not actively involved in the election or political exercise.

Section 3. The Chairman and Members shall serve for two academic school year (including summer) unless they sooner resign, remove for cause or are separated from the university for any reason.

Section 4. Any permanent vacancy in the COMELEC shall be filled in the same manner as provided in Section 2 of this article.

Section 5. The COMELEC shall have the following powers and functions:

a. Administer and enforce all rules and regulations relative to the holding and the conduct of all elections, referends and/or plebiscites;
b. Decide questions involving the qualifications and disqualifications of candidates, decide election protests and counter-protests and any other issue or matter relative to any election, referendum and/or plebiscite;
c. Deputize any student and with the consent of the President of the university, any employee or faculty member to help in insuring a clean, orderly and honest elections or any other electoral exercises; and,
d. Determine the rules of its proceedings for the effective implementation of its powers and functions.

Section 6. Decisions of the COMELEC shall be final.


ARTICLE XVII

GENERAL PROVISIONS

Section 1. This Constitution shall be known and hereby referred to as the Constitution of the Student Government of FEATI University (CSGFU).

Section 2. The office of the FUSSC shall be at the second floor of the Science Building, FEATI University, Sta. Cruz, Manila.

Section 3. The seal of the FUSSC shall be circular in shape and consists of a wheel, a torch in the center, a dove with an olive branch, and two hands clasp together and shall bear the acronym "FUSSC" in the middle. The wheel represents the technological aspects or nature of FEATI University, the torch represents the educational aspirations and enlightenment of the students, the dove with the olive branch represents the students' desire for peace within and without the university campus, and the hands clasp together represents the desire of the FUSSC for unity among all the sectors of the university.

Section 4. The motto of the FUSSC shall be "Education for Unity, Service and Progress".


ARTICLE XVIII

AMENDMENTS

Section 1. Any amendment to this constitution maybe proposed in writing by any student, group of students, a member or group of members of the FUSSC or DSC.

Section 2. The FUSSC President shall create an Ad-Hoc Committee out of the membership of the FUSSC and DSC to conduct public hearings among the various sectors of the studentry on the proposed amendment/s.

Section 3. If the findings and recommendations of the committee show an overwhelming support for the amendments and the FUSSC by a vote of at least 2/3 of all its members approve it, then it becomes a part of this constitution.

Section 4. If the result of the public hearings conducted by the Ad-Hoc Committee does not show a clear mandate of rejection or approval of the proposed amendment/s and the President of the university decides to submit said ratified by at least majority of all students of the university becomes part of this constitution.

Section 5. In any case no plebiscite regarding the ratification of this constitution or for the amendment thereof shall be held without prior consultation with and approval of the president of the university.

ARTICLE XIX

TRANSITORY PROVISIONS

Section 1. All assets of the previous FUSSC shall automatically become the assets of the FUSSC under this constitution.

Section 2. The first election under this constitution shall be held on the fourth Friday after the ratification of this constitution in a plebiscite.

Section 3. Subsequent elections shall be held on the last Friday of July of the 1st semester of the school year.

Section 4. The President of the university, upon petition of the COMELEC may reset the date of the election. The petition must state the reasons therefore, like fortuitous event, force majeure, deterioration of peace and order or any other similar cause that shall prevent or disrupt the holding of a peaceful, orderly, honest and credible election.


ARICLE XX

ADVISERS

Section 1. The FUSSC shall have two faculty advisers who shall be appointed by the President of the university from a list of at least five faculty members who are mutually acceptable to him and to the FUSSC.

Section 2. The Adviser of the DSC shall be the head of the course department. The DSC Adviser may designate as his assistant any of his faculty members in the department.


ARTICLE XXI

REPEALING CLAUSE

Section 1. The provisions of the Rules, Regulations and Guidelines creating the present FUSSC as embodied in the FEATI Student Handbook, which are inconsistent with the provisions of this constitution, are hereby repealed.


ARTICLE XXII

EFFECTIVITY

Section 1. This constitution shall take effect immediately upon its approval by the President of the university concurrently with the approval of at least 2/3 of all the current membership of the FUSSC of if after consultation with the President of the university is submitted in a plebiscite and ratified by at least a majority of all the students of FEATI University.
